Hi, i sold my mobile phone on ebay 2 weeks ago to someone with no feedback, they took a week to pay, left me feedback and e-mailed saying they were pleased with the phone. Two days latter she e-mails asking for a refund as the battery was'nt holding its charge, i replied straight away and offered to buy her a new battery, this morning (3 days latter) she e-mails saying 'thanks for the offer but i still want a refund'. Im a bit anoyed as there was nothing wrong with the phone, the battery was fine when i had it and i offered a new battery which if there was a problem would solve it. She only payed £30 for the phone decribed as in used condition.

Should i refund? remembering she has already left good feedback.

if she paid by paypal she can open a dispute.
she would need to return the phone, provide a tracking number to paypal to prove she has returned it and then paypal will refund her.
paypal always find in the buyers favour and sometimes they don't even need the proof she returned it...

If you know for certain the battery was fine when you sent it then just sit it out. You have offered to send her a new battery, which makes me think she is trying it on. Just wait and see what she does. If she returns it and its a different battery, state this in your part of the paypal claim.

Not sure tbh. why not accept the new battery? Chances are she has either changed her mind about the phone or found another she likes better.

Ask her to send you the phone back and then you will refund. Don't worry about the feedback, at least it was good.

DOn't refund unless she sends the phone back to you - she can;t have her money back and the phone. Tell her this, politely. If she won;t return the phone, she doesn;t get the refund, simple as that.

Sugarpear- thats what i thought, why wont she try a new battery, this makes me think she has changed her mind about the phone and just wants a refund.

I'm tempted just to leeve it and see if she goes through paypal.

She sounds like a scammer if she has been offered a new battery and won't accept. You could offer her a partial refund (have no idea how much the battery is worth compared with the rest of it? is it about £5?). If she goes through PayPal, I think sellers usually lose and you could be left with no phone and no money. It is really gutting when people do things like this, it's really just stealing.

I reckon she had the exact same phone anyway, but hers wouldn't hold a charge, so thought she'd try her luck. 2 years ago I wouldn't have said that, but some people are really devious!

Flibbertyjibbet · 13/02/2008 22:19

I wouldn't offer her a battery again, just tell her that you can't give a refund without having the phone back and that you will refund her the cost of sending it to you by recorded delivery.
That would still be cheaper than buying her a new battery.

I'm amazed that anyone would agree to refund a buyer without having the items returned (OK perhaps you could send them the cost of return postage in advance, but nothing more till you have the item back).
I did once give a buyer a partial refund when he disputed an item's condition (it was an old magazine and there is no objective definition of 'good' condition after all) so I offered him the option of half the cost back and keep the magazine, or return it for a full refund and he took the former.
But in the case of this buyer, if she reckons the phone doesn't work, she should send it back to you: if she doesn;t want to send it back, why should she have it free?

ONLY REFUND HER IF THE PHONE IS RETURNED! I WAS SCAMMED ONCE BY THE PERSON TELLING ME THAT THEY WILL SEND THE PHONE BACK ONCE THEY RECEIVE A REFUND, AND I NEVER RECIEVED THE PHONE BACK (sorry for the caps!
