Shoes are much larger than expected - can I get a refund?

I bought some ankle boots, and they were listed as Unisex Adults and that they 'will fit' the size listed, my usual size, 5.
They arrived but they are huge. I'd say they are 2 sizes bigger than my usual size even though the size marked on the shoe is 5.

How do I word my refund request, please?

I don’t think you would be entitled to request a refund sorry, the item was listed correctly?

They are not suitable don't fit, can I have a refund please.
You could argue not as described to avoid paying return postage and eBay will undoubtedly side with you, or you could just pay the postage yourself and get the cost of the shoes refunded,.minus postage costs.

The only thing in the listing that persuaded me to buy them was the wording
"No Returns if your a UK Size 5 they will fit ."

They don't fit and wouldn't with thick socks and insoles. They might fit 6.5 - 7.5

That wording makes me think the seller knew perfectly well they wouldn't fit!
Check on eBay's terms and condition, I'm sure you can return as the item is defective. Might be worth taking a photo with a ruler on the sole of the boot to prove it's too big to be a five.

It sounds more like the seller has made a mistake, can't see why they would intentionally try to deceive over a shoe size, when all you will do is return them at their expense.
Just message the seller and ask to return and take it from there, you will be entitled to return as they are not as described.

It depends. If it was an auction, the shoes are marked as a size 5 but are simply extremely large fitting you would not have the right to return.
If it was buy it now you have rights under distance selling regulations.
Fit is a chance you take with clothes or shoes bought through auction. You could sell them on and put the actual measurements on.
Auctions are not covered by distance selling regulations.

I got a refund. The seller relisted them with the same description and they sold.
