I sold an unopened makeup palette. seller has just contacted me with a photo to say it is damaged. Do I have to refund them? Looking for advice.

to add it was sealed and I had never opened it and her photo is of the inside so i have no idea if it was damaged in the post or already looked like that before i sent it.

Should really have checked before selling. No choice but to refund. Is there and point in having it returned to you first? Although you should pay the return postage.

But then I could claim it was new and unopened if i had unsealed it to open it.

Either way (damaged in the post or damaged before sending) it is your responsibilty to refund the customer. If she has a photograph of damaged packing you might have a case with whatever courier you used to make a claim yourself.

Just refund her now, it will save you the hassle of her opening up a case & her winning etc. If she has sent a pic of it damaged, you don't have a leg to stand on unfortunately, wether it was already damaged, or got damaged in the post, you will never know.

Well, i messaged them back straight away asking what they wanted to do. It was 3 days ago, Obviously I will refund, but I am still waiting for a response.

Its worth asking as they might settle for a partial refund, or if they are trying it on they might realise you are not a soft touch and drop it.

I have still not heard back from her after offering partial refund.

You might get lucky, because she has a set time in which to resolve the problem.

Given that it seems ebay tend to be on the side of the buyer. Is it worth sellers taking photographs of items being packed and sealed? Would that be worthwhile when trying to defend cases?

Annoyingly you'll have to refund in full.
