I've been scammed advice please

[1dilemma]

Like so many on here I've been scammed, I pid with paypal but it wasn't an e bay item, seller strung me along and said they got caught by postal strike.
It's more than 40 days does anyone have any idea whether I can put in a claim will it be allowed?
