Buyer contacted me 3 months after sale saying trousers are flaking

I sold a pair of vintage faux leather trousers in January.
Checked thoroughly before sending and there was no peeling or flaking.

(They are miss sixty pvu or similar coated cotton).

Buyer had contacted me saying she hasn't worn them til now because of lockdown, that black stuff/finish is staining other things and that the surface is flaking ..
Asking he what I'm going to do about it, and that I should have pre warned her.

I wore them once, to my memory, in 2010 and didnt notice any black colour transfer, and I checked the surface before sake a X they weren't peeling or flaking.

What do I do in these circumstances?

As usual I can't find any easy way to get through to eBay support and there is no answer specific to this issue.

(I wouldn't/couldn't have payed the new price in the 90s for them incidentally; I think they were nearly 100. I was delighted when I found a pair second hand.).

It's been 3 months so she can't raise a case through Ebay or leave negative feedback. Google says its 180 days before a buyer can't raise a dispute on paypal though so she may try this.

Hopefully someone who has been through this process before can explain how it works, but an item that has been used for 3 months surely wouldn't be refunded, the buyer could easily have done something to damage it themselves.

I would say they weren’t like that when you posted and can’t do anything now. Worst case scenario PP insists on a refund - but if you offer one you definitely have to give it! I think this is the risk you take with vintage gear.

She’s had them 3 months, that’s ages! You don’t know how she’s stored them, you don’t know if she’s worn them every day, you don’t know if she’s dipped them in acetone!

Your advert said 90s, it’s 2021, theres potential for them to be 31 years old! They obviously won’t be the same quality as brand new. It’s common sense to check the quality of things you buy second have straight away, it’s her mistake! I agree with the cream/lotion comment.

Could only afford them in the sale.

If it makes you feel.any better, I couldn't get into those for a nearly a decade .. which is why I finally listed them on eBay ...

Now this.

I don't know whether to ask PayPal, I don't think I've ever had to contact PayPal support, no doubt it's like trying to get in.communication with an actual person on eBay.

eBay tend to side with the buyer unfortunately in my experience. However if it’s true that she can’t leave feedback now I’d just ignore her. It sucks though when someone complains. I’ve had this happen a few times and I’m an honest seller. Some people are properly cheeky!

I recon she purchased them, has now tried them on to go out to a restaurant or pub etc and realised she doesn't like them. Knows it's too late for a refund so has hatched this plan.

Are they polyurethane (well, polyurethane coated cotton)?

People have mentioned sweat and/or lotion perhaps causing the residue ... It seems reasonable.

People have also mentioned the age, I don't know, they seemed fine when I sold them, though I hadn't worn them in tonks.

I'd have thought that if PayPal side with her and issue a refund they will still require her to return them - so at this point you have nothing to lose by not offering a refund. She should have checked them properly sooner - you sold them in good faith and the photos she has sent do not illustrate her complaint.

But she can open a SNAD claim with Paypal within 180 days of paying (if she knows how). Or she could issue a SNAD via her CC if she paid into Paypal that way. In THAT case, if you lost, there'd be an additional chargeback fee to pay ~ £40.

Whether or not she'd win is another matter - 3 months have elapsed, and the SNAD is not a guarantee. Goods must be received in the condition described, but if they don't actually last long, that's a completely different affair.

Personally I'd chance it - and if she opens a claim fight it.

NB, if she wins a Paypal claim, she WON'T need to return the item.

Ok so the buyer is still within the time frame to open a PayPal case BUT it is a common misperception that the eBay and PayPal customer protection acts as a warranty; they don’t.

They guarantee that the item will be fit for purpose / as described when the item arrives, not that it won’t develop faults further down the line.
So if the buyer opens a claim saying that they have now started to flake / peel, just reply to the claim reminding PayPal that they were fine when they arrived and their protection doesn’t act as a warranty and the case will be closed in your favour. I always like to call PayPal and speak to someone just to confirm.

So the refund of £50 odd quid plus postage would he taken out of my account, and they'd charge me a £40 chargeback fee - potentially I'll be nearly 100 quid out of pocket if she opens a PayPal dispute and they don't see my side?

Paypal are usually good if you talk to them i recently got a refund after trying to speak to the company they ignored me I went via PayPal they ignored my message via PayPal so I asked for a refund due to them not engaging with me or PayPal and they refunded me I now have a pair of size 5 trainers that are useless to my size 6 FEET (im giving them to my mom now she is the only size 5 I know 🤣)

I don't know what to do.

Not respond/ignore - which feels rude and will probably provoke her fully into opening a PayPal dispute .. but if I answer were going to get into a back and forth where she'll insist as she's already said that they're "unwearable" and that i must have known they'd go like that ... And I'll be saying they aren't sticky or flaking or giving off any residue when I sent them.

I've noticed she said in her mail that she'll send some further photos showing the stickiness/peeling she says is happening when she crosses her legs ... But they haven't arrived so far.

It's just the ones showing the black residue at the waist band.

I expect she's looking for a partial refund (maybe) and I'm wondering whether I should offer it - because if the above happens (full refund and 40 fee) with PayPal, I'd wish I had.

Also I sold them not seeing any flaking or residue or anything but it is v disappointing for her for this to happen. I don't know which of us is responsible for being able to anticipate this might have happened with polyurethane trousers that could be 30.yeaes old and facet been worn in a decade (!)

Of course I only have her word so far that they're flaking/peeling on the legs (as far as I can see in the photos she's sent to date that's just some black residue at the waistband that may be the result of friction, sweat & possibly lotion) .. and if she does send some, how do I know she hasn't purposefully rubbed or damaged them to get a refund because she doesn't like them on or something. 🤷

No - the chargeback is if they open a dispute via their Credit Card company, which only applies if they paid by CC, but you can't know that as you just see the Paypal payment.

Paypal themselves don't charge a fee - if they claim via PP and you lose, they just refund the amount you received.

I've just checked what the chargeback fee is incidentally - was sure it was £35 a few years back so assumed it would be a little higher, but nope - it's now £14 so my £40 was way off!
