Paypal disputes - do they just look at the listing, or questions responded to as well?

I am looking at a dispute over the most disgusting buggy you've ever seen - it stinks of smoke, is covered in gunk, has broken clips, is well worn and totally disgusting - in fact I can't have it in the house, it smells so bad.
It said 'very nice buggy' but also 'sold as seen' so does this cover them? Stupid to have risked it, I know, but I asked through ebay questions, did it have stains or damage or anything else, and got the reply 'no stains, ex condition, raincover never used (it has split popper holes so evidently has been)
I am wondering if paypal will take their dishonest answers into account when deciding if it is not as described?

Has anyone else had this happen?

TIA xx

Here is the dialogue, all done through ebay messages:

Dear darren2005dog,

Hi, can I ask you if there is anything wrong withit please? Such as tears or stains, broken hood, brakes not working etc! Just to be sure. Many thanks, Susie

  • silver.machine

Dear silver.machine,

no the buggy is in ex condition and no stains or broken hood brakes are fine, only selling due to having to get a double buggy.

Dear darren2005dog,

Thankyou - would you mind if I arranged my own courier, I use Payperdrop as it is only 6.99 for a parcel this size? If we could use them then I will go ahead, oh yes one more thing, is the raincover in good condition without any rips? Thanks again, Susie

Please someone? Also could you tell me if the Maclaren Techno is supposed to look like this from underneath? I've not had one before.

I will upload photos of the actual pushchair to my profile, unless there is an easier way - I haven't picturetrail.

Not sure how paypal decides, why dont you post on the ebay help pages to ask this, there are lots of helpful folk on there. Had a paypal dispute myself over a buggy but stupidly I closed it before I was fully refunded.
Good luck. I have Techno so can advise but not too sure what you meant, is the pic already on your profile?

FlightAttendant · 17/10/2007 14:45

oh thankyou Panna, I'm just so angry at the moment - I'll go and ask there.

Yes, the pictures are up now but very small, I don't know how to link to a photo itself?

It looks like the bottom bit of fabric has just been cut off? Or are they all like this? It looks dangerous as there's nothing to protect the baby's legs from the metal extender bits

Do you mean your third pic?

I dont knwo how to link to specific pics sorry.

There should be a fabric cover (part of the seat section) over the extension bits for the legs.

It looks in pretty poor condition, how disappointing.
Got to go, DS2 just woken up screaming his head off!

FA you might have got this sorted by now but if not have you emailed them and told them its awful and you want to return it? if you have and they say no raise a pp dispute you will most likely have to return it for a refund and you can use payperdrop for that there is a £4.99 service now!! or if they ignore the dispute you will get refunded 10 days after you make a claim

good luck its horrible when this happens I have had similar thing happen twice in the last month very annoying

FlightAttendant · 19/10/2007 13:06

Thankyou Helen, that's lovely of you...I did get somewhere in the end, I actually had been emailing them and they were steadfastly refusing any returns etc. so I put in a claim through paypal, and amazingly they decided it yesterday evening - I was impressed! No pram shop notepaper required as evidence
So when the seller heard the result he offered me £30 out of the £50 just to keep it. I agreed because I'd have lost twice the PPD fee if I'd returned it - it's a great price isn't it? I only ust realised it was cheaper on their website! So have cleaned it up and I'm pretty sure it will fetch £25. The frame is fine, covers quite grotty but at least they're clean now.
Thanks again, you're a good person to know!
