Item doesn't fit and buyer wants a refund

Sold a top couple of weeks ago, about a week later seller requested a return because it doesn't fit, opened a case as not as described. The top is definitely the size I stated, although small fitting, which I also stated.
I replied to say unfortunately I don't accept return if item doesn't fit but what will happen now, case is still open and seller not replied since I replied to say I don't accept refunds.

They've opened a item not as described case - You have to refund or accept the return, then refund.
Not as described cases are all automated, Ebay people won't look at the messages etc unless the case gets appealed once it closes.
If you don't accept the return Ebay will close the case in buyers favour, refunding them from your account - resulting in a defect on your account. You can appeal the case once buyer has won, but I wouldn't bother as they will side with the buyer.

Ask them to send it back to you so you can re sell it, they don't get to keep it and have a refund, they could be lying!
You might find they'll change their mind then as they have to pay to post it back to you

I recently bought 2 new tops on ebay for my dh which were too tight.I informed the seller,paid the return postage myself and got a refund.
What RedWineAllMine said is correct.They will side with the buyer.

It's really unfair as now the case was opened and eBay have said they have to return and I have to refund and pay postage. I have bought lots of things on eBay that didn't fit but I wouldn't have dreamt of opening a case, it's a risk I take when buying!

Think I am going to close my eBay account down, to much bother!

No need to close your account, you just need to put all measurements in the listing, and photos with a tape measure.

You might still have some return requests but point out in the section under the title (for used items) that the measurements are included in the listing and they need to read it. Some people are still too stupid to read the listing and just look at the first photo so put tape measures in that one.

Sadly Ebay is a lot more hard work than it used to be. Don't stop selling you might have something I want to buy finding things I want is getting harder.

There's a distance seller act though which online sellers have to comply with.

Anyone is allowed to return any purchases within 14days without giving a reason at all. I think Ebay as a platform has to comply with this law.

I always presumed it was tough luck if you bought an item and it didnt fit so I've never returned anything!

I'm really annoyed with myself now for not returning items, it's part of the reason I stopped buying clothes from Ebay as they don't always fit properly.

This only applies to business sellers, not private eBay sellers. If a buyer requests a “non fault” return then a private seller is not obliged to accept it.

No need to close down your account. You need to take the bad with the good on Ebay. This isn't a regular occurrence, and won't happen often, but if you sell on eBay it should be expected every once in a while. The good definitely outweighs the bad.
