Am I within warranty period?

Bought a refurbished phone off an ebay shop on 29 May. Keypad was faulty so returned it. They sent me another faulty phone (Siri not functioning). Lots of hoo-haaing inbetween plus I was abroad, so was not able to return the phone until July, they received it on 30th July. This time I asked for a refund.

They want to send it back, claiming I am not within 60 day warranty period. Regardless of the fact that I don't think they have a right to make me pay and keep a phone that was not working in the first place, am I within the warranty time period (just!)? When does a warranty time period start/end?

You don’t get a warranty as such with items purchased on eBay. You do however get a guarantee that the item will not be mis described. In simple terms that means that it will be working when you get it.

This eBay guarantee is valid from 30 days from the latest delivery estimate.

HOWEVER you have a PayPal guarantee and this is valid for 180 days after purchase.
I would remind them of this and tell them that unless you get a full refund you will open a PP case. I take it you still have the tracking number and proof of delivery from when you returned it? You will need this to show its been returned and obtain a refund.

In future don’t get involved in returning faulty items off your own back for an exchange, ALWAYS open an eBay case for a full refund.

I opened up a paypal case last night actually so waiting to hear. It's just that the seller emailed me again this morning stating the warranty.

I did initially open up an Ebay case and although I was within 30 days for returning the first phone, returning the 2nd phone took me over that 30 days. Wondering if the 30 days should have started again when I received the 2nd faulty phone.

They may state it is outwith the warranty, but unfortunately for them that doesn’t override your PayPal buyer protection.

Just be aware that PayPal will request you return the phone for a refund, which of have done, so make sure you have the tracking number of the original return to hand, as you will have to upload it.

No, it won’t have. This is one of the reasons why ebay won’t get involved with exchanges on faulty items,
It gets too complicated. The only option they support is return it for a full refund.

Don’t try and resolve matters outside the ebay resolution Centre again, you need to go through them to maintain your buyer protection.
