Is this a lost cause? eBay tracked delivery never arrived

I bought something from eBay that the seller sent by Hermes tracked delivery. The tracking says it has been delivered and left securely in our porch. But I don't have a secure porch, I didn't receive a delivery card from Hermes and I haven't got my item.

Seller opened a case with eBay and they found in favour of seller as the item was tracked and is showing as delivered.

Is there any point in taking this further either with the seller directly or appealing with eBay?

I would just dispute it via whoever provided the card you paid on.

If eBay have sided with the seller there's no hope with an appeal. I've had this situation twice and it always goes in the sellers favour, as far as eBay are concerned if the seller can provide proof of postage and in this case delivery too then the seller will always win despite the fact that delivery has not been to your address, and there's no way to prove you didn't receive it.

Yes my understanding was that eBay normally side with the seller if they provide tracking that says the item has been delivered. I just wondered if there might be some hope given the courier has stated they left the item outside (and that I can prove I don't have a secure porch)

Contact MyHermes, they often take pictures of where it was delivered.

Can you do that as a buyer, I thought the courier only dealt with the person who ordered the service?

Worth a try if so!

It's not a particularly high value item but it is a discontinued product I'd spent ages trying to track down so I am a bit gutted it is missing and losing the money too is just the cherry on the cake.

You can get in touch via My Hermes. Tell them it didn't arrive, and see what action if any they tell you to take. My Hermes are terrible for this, I won't order stuff if I see Hermes as the courier. Can't beat the good old Post office or Collect plus for couriers.

MyHermems won’t deal with the OP. She isn’t their customer. The seller is.

Your only options are to appeal with eBay, or to politely ask the seller to push this with myhermes that the parcel wasn’t delivered and claim compensation to pass on to you. I had this with Hermes and surprisingly they paid out quite easily.

I had this as the seller. The buyer opened a case that they lost because the delivery notification said "delivered".

I chased up with Hermes (as 19lottie82 says, the buyer can't) and it was clear (Google street view can be really useful) that even if they had actually delivered the parcel, they'd just left it outside a house for someone to pick up and walk off with.

On balance I thought the buyer was being honest and I refunded. I dealt with Hermes and got them to refund the delivery cost together with the minimum insured amount. I was out of pocket but was content not to feel I'd possibly ripped off the seller.

It is worth discussing this with the seller. Although you would need to be lucky to get a positive response.

I've managed to get a response from Hermes as the buyer - they're looking into it so we'll see what happens.

I also had the same as a seller but with Royal Mail showing as delivered tracked buyer said never arrived. EBay found in my favour too but I raised a dispute with Royal Mail who refunded me and I refunded the buyer.

nauticant · 12/04/2018 20:39

That's interesting Bubbinsmakesthree. I'd be interested to hear how far Hermes are willing to take this with you as the buyer.

I have had almost the exact situation, I had to check and make sure it wasn't my post! My Hermes said they left item securely in my porch. I don't have a porch! When I said this to them, suddenly it had been given to a lady outside the property! I had been in the entire time and no one had tried to deliver anything!

Anyway, it never got resolved. My Hermes had proof of delivery and seller had proof of postage. It wasn't a high value item at all but it was the principle. I never order anything now where the courier is my Hermes. Hope you have better luck than me!
