Think I've been scammed

Hello - so I ordered a dress for £50 from abroad (free postage), advertised as size UK8. When it arrives, I try it on and it is far too big. At least 2 sizes.

I look at the label and the size label has been cut off. I message the seller asking if I can send it back as it is clearly not an 8 (and in this case, as the dress was not as advertised, they should pay return postage). If the size label was there then I would accept the designer just "comes up big" and it was my mistake, but the size had been taken off!

I messaged her through eBay and asked for a full refund. She replies saying she'd have to deduct 25euro postage that she'd paid (despite it being listed as "free"!) AND the Paypal charges of 15%! Then she implied I'd "accidentally" cut the label off myself because she sent the dress with a size label....and I'm lucky she hasn't deducted the dry cleaning fee...she then got quite nasty saying "sorry you don't know your own size" etc.

We are at a stalemate. If I open a case after 10 days, would I be likely to get the full refund money? Just want to send the dress back and be rid of it.

Open a "not as described" case & EBay will side with you, she will be liable for the return postage.

She's just trying to fob you off & avoid refunding.

Yup, as advised just open a case. If the seller doesn’t issue you a pre paid returns label within 8 days then escalate it to ebay. They will then either refund you or give you a returns label to send it back for a refund.

Was it a German item? They come up bigger. However that is no excuse to lie to you. She removed the size tag so that she could try to refuse a return as there is no evidence of the size. Sneaky.

Open a case today. This is important.

Take photos of the cut label and if you can, with a tape measure to show how much bigger it is than a size 8. Submit these photos when you open the case.

Open an item not as described case.

In this time they expect you to sort things out with the seller. But she has made her opinion known and is not going to be helpful. * *

She may offer you a discount knowing full well if you agree then EBay will not get involved.

After a week you can then progress your case by pressing the button asking eBay to step in and sort this out for you.

They will arrange a prepaid label you can print off and return item, or they will give the seller the option of refunding you in full including postage if paid.

You are covered by ebay guarantee, it will be ok.
