Item received not as described!!!!

I was the winner of a digital camera Here's the description of the item he had on his listing:

tHIS IS AN UNWANTED PRESENT AND HAS ONLY BEEN OPENED TO MAKE SURE ALL ACESSORIES ARE IN THE BOX,WHICH THEY ARE,AND TO MAKE SURE THE CAMERA WORKS,WHICH IT DOES.THIS IS IN PERFECT WORKING ORDER AND WOULD BE AN IDEAL DIGITAL CAMERA FOR A BEGINNER.ANY QUESTIONS PLEASE EMAIL ME.

Won it for £24.00 and then £10 P+P

I received the camera today, its casing is all scrathed and the display screen BADLY scratched, also the writing on the camera is not fully visible indicating this has been well used.

I emailed the seller advising I had recieved the item however was not happy as it was not as described here's what he emailed me back

As stated in the description this is in perfect working order and was BNIB l never said it was in perfect condition.

Again I emailed stating BNIB I expect it to be brand new and not marked etc

No response from that 1 though. The listing ended on 10th April and I paid immediately however cant open a dispute for 10 days

Any advice on this please would be most appreciated

Wouldn't be happy, have you left feedback? Can ebay get involved? I have never had this sort of problem so will be interested in the outcome but I would certaqinly take it further.

When I tried to open a dispute via paypal it said I have to wait 10 days

I have just left negative feedback for him though.

I am soooooo,

keep all correspondense between the two of you as ebay/paypal may require them.

If you do return for a refund send recorded as he will prob be the type to say I hasn't received it.

be prepared for a neg - he looks like a nasty piece of work.

he seems to sell quite a lot of 'unwanted gifts'

You know you are in the right and you have proof - a photo will show that it is not new as he clearly states in item specs.

argh - hopefully leaving the neg won't go against you.
ebay like to see that you have done all you can in correcpondense to resolve the matter prior to opening a dispute. I'm not sure how they view leaving neg FB prior to the 10 days.

I thought you could launch an item not as described complaint on ebay itself, straight away?

escalate to a claim straight away - don't give him chance to pull his money out of paypal

it's still 10 days on ebay before you can open dispute

That's a bit shit, isn't it?!! I suppose that's to give the seller time to resolve it.

He has replied with

As far as l am aware it has never been used

WTF!!

Well the cheeky F**r has left me negative saying it was unfair of me to do so as I never contacted him

CHEEKY MAN!!!!

I have responded though and said well I have on 3 occassions prior to leaving hegative just have to see what happens now
