I did open a case but the seller hasn't directly responded to the case and had just asked me to send it back for a refund.. obviously I will do it recorded? But just wondered will I be covered through eBay if he decides to be awkward? Thanks

Is it a "not as described" return? (i.e. there is something wrong with the item?)
if so, don't send it back recorded as you won't get the postage costs back. sounds like the seller is just trying to avoid paying the return.

ask the seller to accept the return via the already open dispute, and then you will be issued with a pre paid (and tracked) returns label which you can use to return the item. this will automatically link in with ebay so they can track it and refund once delivery has been attempted.

if it is a "non fault return" (you've changed your mind), then that's fine, just send it back recorded and upload the tracking details against the return request.

PS If the seller won't communicate via and accept the return through the official dispute (assuming its a not as described return), then ask ebay to step in and help as soon as you can. I think this is 7 or 8 days after the return request was opened.

Yes basically not as described, he is completely ignoring the request and telling me to return. I just want to send it back ASAP so if I send it without eBay tracking, what if he says it's not been returned even if I send it recorded etc will it be his word against eBay's?

Only communicate with him via the return request messaging system from now on - Tell him to accept the return via the official channels, so you can get a pre paid returns label.

As advised if he refuses, ask eBay to "step in and help", and you will then be provided with a label.

ONLY send it back with one of these labels, do NOT send it back, covering the postage yourself.

Thank you.
