Help? Ebay say I'm violating trademarks and have removed listing. But other people are selling the same thing!

I am selling- or trying to sell- some Rayban sunglasses. I've just listed them and now Ebay have emailed to say they have removed the listing as it violates trademarks etc and may be a fake item.

I've heard this happening to other people but before I listed them I spent a lot of time reading other sellers' descriptions of exactly the same sunglasses.

Where am I going wrong? Why are their sunglasses there and mine aren't?

Yep- absolutely 100% real!

Looks like eBay have pulled your listings because they think your sunglasses are fake. Get in touch with them, telephone is your best option, and discuss how your can prove they are genuine. Do you have a Proof of purchase?

What NOT to do is attempt to relist with input speaking to eBay, as it will result in a temporary ban.

I wouldn't waste too much energy on worrying about why other listings remain and yours had been pulled. eBay simply don't have the resources to remove all rouge listings.

Thanks. Have called and spoken to them and they want a copy of the receipt. Not sure if I've got it- so then what??? Anywhere else that could accept a listing?

I have had another email conversation with them. They now say that a receipt is not proof they are genuine glasses. The receipt is an email receipt from Ray Ban in the name of DD who I am trying to list them for.

Ebay keep insisting there is something about the listing that shows they are fake. What to do? They won't say what looks fake but basically are accusing me of criminal behaviour.

The email invoice is from Remix (Ray Ban) and lists the glasses with the price, style, etc. and DD's name. she's also an Ebay user so she could pursue this herself with them.

I'm so cross- I've got 100% positive feedback on Ebay for over 200 items and never had any issues.

What can I do now?

Hi OP - I'm pretty knowledgable about eBay but I can't help with this I'm afraid! And I would be raging mad also.

Maybe Google "how to tell fake raybans" and see if there is anything that sticks out against your description? Sorry I can't be more help.

PS don't email.... Call them (again), IMO you always have a better chance speaking to someone with a bit of common sense

I have no advice to offer, but I feel your frustration. I have had 2 or 3 of my listings removed because they contravened eBays listing policy. In my case It was because the album covers of the LPs I was selling contained images of bare breasts etc.
When my listings were pulled there were other copies of the LPs for sale displaying the exact same photos and plenty of copies has been sold previously.
I tried complaining about the unfairness, but got nowhere so I re listed with bits of paper stuck over the offending parts.

I am really annoyed - and puzzled.

The glasses are DDs- she's an adult and had listed them herself. The listing was pulled so she thought she'd written something in the description that they'd picked up as fake so she asked me to try.

I scoured other listings for the same item and had a go. Sam result. Clearly it's a computer program picking up something either in the photos or the wording of the listing because there are loads of other Rayban Wayfarers listed . I used the words 'authentic' and 'genuine' - don't know if these are 'trigger' words for 'fake'!!!

Anyway- the whole thing is ridiculous. DD has the emailed invoice from Remix which shows her name, date, price, etc etc. I sent them that- as asked for by them- and yet they now say because of the number of fake invoices they won't accept that as proof.

What is completely odd is that other listings are there and appear no different to mine!

They are now saying- in their email- that they have no issue with me as a genuine seller and someone with a good feedback score but insist - in a very cloak and dagger way- that there is 'something' about the item that flags it up as a fake (but they can't tell me what!)

I've googled' fake Rayban's and all that comes up is lack of serial number, Rayban etched on the wrong part of the lens, stuff like that- none of which applies to these.

If they have a serial number, can Rayban confirm they're genuine?

This happened to me when I tried to sell some Timberland kids clothes. I gave up in the end.

Playing devil's advocate - maybe you were sold fake Raybans in the first place?

If you copied other listings then you probably copied the bit they see as fake.

Sell elsewhere eg Vestiaire Collective / Hardly ever Worn It. You can upload a pic of receipt or there is a space for adding serial numbers etc.

Or there is Jolicloset too

My daughter sells loads through Bepop. You might have better luck there.

Flab not so. There are often key words that flag up listings to eBay.
It would take more than just a report from a third party for eBay to remove a listing.

I had exactly the same thing happen with a pair of DMs.
eBay do not support sellers. I had a receipt but as it was not from a genuine DM shop they wouldn't accept it even though I contacted DM, sent them a photo of the boots and they told me they were genuine.
Surprising as it was DM who complained. eBay told me.
I used to sell quite a lot on eBay and I found that if anyone, like the manufacturers of the item or the purchaser, complained they always took their side.
I don't think they have time or inclination to decide for themselves if things or genuine thus any complaint listings are removed or if an item has been sold the purchaser is given a refund.
IMO not worth fighting them.
Is there a local FB group you can sell them on ?

Quite often it is the copyright holder who complains.
However when you received the email from eBay telling you your listing has been pulled, there should be contact details where you c an get in touch with them to discuss the matter. You're better doing this than trying to argue your corner with eBay.
