Paid via paypal, collected but item not as described

I made the age old mistake of sending DH to collect a pushchair i bought on ebay (paid paypal). What he brought back was not what was described.
The photos listed must have been from before they used it
The item was listed as in good used condition. I emailed them asking for more detail of the condition and they replied it had a few marks, but what you would expect from light usage.

The pushchair dh brought back was filthy, the back was covered in mildew, it has multiple holes and the basket is snapped.
I messaged then straight away and explained i wasn't happy and felt i was misled. The seller agreed the hadn't told me about the broken basket but maintained it was in good condition . He then said he would give me a full refund if i returned it, two minutes later another message offering me £15 back..... I replied that I really needed a full refund and would return the item, but I am unsure of how I would be guaranteed recieve the refund if i returned the pushchair in person?
He now has become aggressive, demanding I take it back to him and he will guarantee to send me the refund, because "he is not a robber"....

Help! What can i do now?

Dump it on the doorstep and recall the payment. Then take the hit of negative feedback, because you accepted the item as seen

Yes, take photos as evidence, report to eBay/PayPal as not as described and take it back to them

Make sure you get photos though as comparison and any emails to them send via eBay

you won't get negative feedback as a buyer - Geoffrey is completely wrong about that

tell the seller you are taking it back and you want a full refund. They are very stupid accepting paypal for a collected item. An unscrupulous buyer would claim not received and get a refund. If you do file not as described the seller will need to pay for a tracked return so it would be better if they refund once you take it back. If you do take it back eBay will not force a not as described refund as you will have no proof of the return btw. But you can tell the seller to refund without being forced otherwise eBay will make them pay for a return too.

geoffreys, you can't "recall a payment", and sellers can't leave negative FB for a buyer.

If you open a not as described case, then to ensure a refund you will need to return the item using a method with online tracking, but the seller will need to issue you with am appropriate returns pre paid label. You may need to call eBay to arrange this, as the standard label they will prob issue at first, won't cover a bulky item like a pram.

Also, slightly fraudulent, (?) but you could open an item not recieved case, and as the seller can't prove delivery, then you will be refunded, then you can return the pram.

I'd use the latter as a last resort though..... Give the seller a call and give them one last chance to refund upon return, before you open an eBay case and leave neg FB.

If you do take it back, hold on to it until you see him issue a refund on a smart phone or similar, while you wait.

Simple idea....... Take it back, if he refuses to issue refund on the spot, ell him to issue refund within x hours. If he doesn't open a not recieved case. He can't prove delivery and has pram back anyway, so eBay will issue a refund, no matter how hard he stamps his feet. No harm done, everyone's a winner!

Don't go into details in the eBay case. Just say "I didnt recieved this item." In the comments box and that's it. Once case is closed and you have your refund, only then leave feedback.

How can you say item not received when dh collected it.

Go to Resolution Centre and say item not as described and you want a full refund, attach pics.

EBay has been known to say you don't even need to return it.

LadyB if she does that she will need to return the item by a method with online tracking. She can't just dump it back on the sellers doorstep. This will be a total PITA for such a bulky item.

eBay will only refund without a return if the seller does not respond to the case.

If the OP returns the Pram to the seller then they don't refund, then she can open a not recieved case. The seller will have the Pram, the OP won't and the seller can't prove the OP ever had it in the first place. They've not lost out, they have their item back, the OP gets her refund, no harm done.

I just went to print off the return label and arrange delivery to the seller and it was no longer available as it says the item is in transit and there is a unrecognised hermes number?

I certainly didn't do this, has the seller organised the return and not told me?
They aren't responding to my emails

As advised OP. Just open a not recieved case, then once you have got your refund, return the item to their address.

Report the issue to ebay and tell them that the item advertised was not in the condition it was described. There seller is at fault here and he should in no way be getting aggressive with you. If anything he should be doing everything he can to help you resolve the matter. I would leave a negative feedback on his profile once the matter is resolved.
