Buyer is questioning the size I listed jeans as :(

I sold some maternity jeans from H and M this week. They were EUR 38. According to H and M size charts this is a size 12. (I know they were as that's what I bought!)
Buyer says they are tiny and don't fit her. Now shes' saying they are a 10.
I sent her this link to the size chart.

I also photographed the label as part of the lisitng and said they were H and M size 12.

I have told her I don't do refunds.
She is saying she is a size 10 but can't get into them. Have to wonder why she bought them then? Wld love to tell her she's put on weight but I havent got the guts!!!
I don't want to continue the discussion but will she give me negative feedback :(

Did you list them as Size 12, or EUR 38?

She can't give negative feedback if they were listed correctly. If she does go though ebay.

I listed them as H and M size 12, as if I go into the shop they are on a 12 hanger and I've never seen eBay listings with EUR sizes. I wouldn't think they would turn up in anyone searches so therefore wouldn't sell. Does that sound reasonable?

I had a quick look at eBay refunds policy and it looked as if I've described wrongly I have to refund, but otherwise it's only businesses that have to. Is that right?

H & M come up small in my opinion. That's why I don't buy clothes from there. You listed them correctly.

That's cirrect. Only businesses are subject to the distance selling regulations.

You may be in the right here but she can leave you negative feedback if she wants so in that sense the power is with her. Why not just accept a return and realist the jeans?

I think she'd stand a fair chance of winning a not as described claim here. Euro 38 is usually a 10. If you'd listed them as 38 you'd have no issue.

If she opens a bit as described case, she will win. As a bit of damage limitation you're best to just accept the return.
Chances are any negative feedback will stick, so don't rely on it being removed if left.

If you photographed the label and sent the link to the size guide then she cannot complain as you have given her full information. Tell her she had all the necessary info and not your fault if she did not properly investigate. I certainly would not return them!

willow sigh....... Yes she can complain and if the buyer opens a case she WILL win and the OP WILL have a black mark against her eBay account, and also increases the risk of negative feedback in this scenario.

Yes, I appreciate its unfair, but it's also the way eBay works!

Best just to accept the return now while cases are opened and the OP is forced to pay return postage as well!

you cannot state you 'don't do refunds' - just accept the return and refund in full. Otherwise you will get a neg feedback and a defect too.
