Shoes stretched from wear - no longer the size advertised

Evening All

I purchased a pair of shoes on ebay which are my usual size. Upon receipt, it is clear that through wear they have become very stretched and are no longer the size advertised. I am a 37, the shoes are labelled 37 but are more like a 38 now.

The seller has refused to refund - do I have any options now? If I open a case am I likely to win? I'm very happy to post them back and pay return postage (I know this is the expected process), I just want the money back!

yes - open a case. You may get a return label or a no fault refund. And do neg. Sellers cannot refuse a refund.
