Not as described / damaged item etiquette

I recently bought a second hand pushchair from a private seller on EBay. The seller lives locally and offered to deliver it yesterday - I paid in cash on delivery. Unfortunately after she left I noticed a tear in the basket under the seat which can't be mended... Even more unfortunately it's an American buggy and I discovered today that parts need to be shipped from the US at considerable cost. I know I should have spotted the rip when I took possession of the item, but the seller clearly mentioned in the description that there were no tears to any of the fabric parts of the buggy, which was incorrect. What can I do?

Any chance she wouldn't have seen it either and it's an honest mistake?

Does it affect usage?

Yes, I think it may be an honest mistake - she was very honest about other minor damage (scuffs etc) to the buggy. The basket itself is pretty much unusable - the tear is in a mesh panel and if I put anything of any weight in it, it's going to rip straight through.

you need to message her and ask for a refund - as you paid cash ebay won't get involved. How much was it?

Toptack · 04/05/2014 20:48

It was expensive - £150 - but still a lot cheaper than buying the same model new!

but it is not as described. Have you messaged the seller yet?

Toptack · 04/05/2014 22:22

Yes, have messaged her. She has emailed the manufacturers to see if a replacement part is available - not sure if she is offering to pay for it though! Bloody hell, I wish I had noticed the problem while she was at my house, would have made things much easier.
