Unfair seller... buyer already sold 'my' item though I won auction

I won auction but she says she already sold the item on a Buy It Now . It was actually never listed as having option for a BIN also, though. (I've looked in completed listings and can't see it at all) Surely she should've honoured my bid as it was originally auction listing only.
I'm betting she never did change it to a buy it now, she just agreed to an offer that someone messaged her, and forget to cancel the listing.
(this makes me really mad, as a seller!)
Anyway I can't have the item as it's gone, she's posted it to the person who gave her the offer.(and no, it wasn't a make best offer listing either.. strictly auction)
So eBay are invoicing me to pay.
How do I avoid an unpaid strike?

Email Ebay, or do an 'item not received' case?

PissesGlitter · 22/01/2014 13:36

Email eBay and explain what has happened and they should be able to cancel the payment request

If you are getting emails from ebay saying 'please pay' they are only automatically generated emails and ignoring them won't give you an unpaid strike.

We still get them sometimes when we buy on local pickup basis. You need to ask the seller to please mark the item as paid (even though it was not you who bought it) and email ebay as she has sold 'off site' and that's ebay rules.

Suggest you put in a non-performing seller type complaint and leave her suitable feedback and low stars.

leave a neg and low stars and if you want to avoid a strike and for your neg to count then do go ahead and pay - then log into paypal, file a not received and get a refund.

it is now showing on Completed Listings.. she definitely didn't change it to a BIN. So, I was the winner, fair and square. I left Neutral Feedback but shouldve left Negative, i realise . Is it too late? Can I withdraw feedback?

no you can't change the feedback to a neg.
