Not sure what to do (if anything) re clothes bundle I bought.

Hi all, my problem is I have just bought a bundle of men's clothes for ds1. The description states that they are in good used condition, but may need a wash as have been in storage. Fine so far.
They add that the clothes are ' sold a seen/advertised.' And that they will not do refunds or partial refunds. Okay.
No where does it show or mention damage, holes or repairs on any of the clothes.
I assume this means there are no holes, tears, stains, damaged bits, missing bits or repairs on any of the items shown in the pictures?
Anyhow, my problem is that two pairs of jeans have holes, one is the back pocket has come away and the other has a hole on the bum next to the pocket (it's not small). One pair of track suit trousers have been mended and look rubbish and there is a small blob of paint on a track suit top.
What, if anything can I / should I do?

That's not good used condition. I would say that good used condition is maybe a bit faded, a little bit of pilling, not holes, visible mends and stains. I wouldn't hand down (for free) clothes in that state, never mind try to sell them.

I'd ask the seller for a refund, and if they refuse, open an ebay case for item not as described.

Yeah I'd definitely say you didn't mention any damage so I'd like a refund. Go through eBay if they don't co operate

Message the seller saying you will be opening a case as the Items are Damaged/not as described & then open a case .
Do not fall for the 'If you close the case first then I will refund you' as they may not refund you & you won't be able to open a case again for this item .

Contact the seller and let them know that you feel the damage was not described and that you are not happy with the items you bought. These should have been described properly and probably not ebayed at all!

If you are not happy with seller's response then let them know you have no option but to open an item not as described case.

If they accept the items back they should refund your postage as items were not as described but sounds like they might not be that helpful.
You will just have to follow up with ebay and leave a neg if the seller does not act in a satisfactory way.

Don't accept rubbish. I hate it when people send things that are tatty - it's such a waste of time sorting it out. Good luck!
btw what is their other feedback like?

Wow thanks. They have 99.8 feedback, two negatives one about clothes not being clean and one complaining about postage costs. I figured they have noted the clothes have been in storage and you don't bid if you're not happy to pay the cost?
So i should message them first, what should I put? I feel a bit nervous about it tbh.
Will I be asking for a full refund ( inc p&p) or just some money back for the damaged clothes? Will I need to send it all back?
Really sorry to bother you all.

None of the clothes are dirty BTW. The rest of the clothes are fine, 4 things out of 12 are not. If I want some money back how much would be acceptable? 1/4 of what I paid? Including/excluding post?
I'm sorry to need walking through this so much, I'm not very experienced at this eBay lark and have been really lucky up 'til now I guess.

you cannot force a partial refund, the seller has to agree to that

chances are ebay will tell you to return tracked for a full refund - but you will need to pay to return them. my Hermes or Collect + will prob be the cheapest. Then you can leave appropriate feedback and stars too.

Ok cool, I wasn't thinking I could force things, just if they were happy with it sort of thing?
So I lose one set of p&p or both?
So I contact the seller saying;
'The items you sent me were not described correctly, two jeans have holes, one pair of track suit trousers have a visible mend and the zip up jacket has a little paint on the sleeve. They should not have been given away let alone sold as 'used good condition'.'
Leave it at that and wait for their response or add anything else? Or write something completely different?

I'd be tempted to take photos of the damaged items too and attach them to the contact you have with the seller. See what action they offer to take, and take it from there.

I once bought a jacket not as described, sent photos to the seller as evidence (so ebay had access to them) opened a dispute said I'd be happy with a partial refund due to the cost of the return (it was a heavy jacket) and ebay agreed. Definitely worth trying.

Was talking with DH and he reckons that because they stated 'Sold as seen/as advertised' that there is no point.
What should the message say, that I send? Don't want to come across as an arsehole but nor do I want to be a wimp IYSWIM?
I will send photos with the message, especially if it means that should it come to it, then eBay can see them too.

Sold as seen - were there pics of holes / paint marks? If not then you should get a refund.

Ebay usually find in favour of the buyer

sold as seen means nothing

just send message saying - 'I have received the items and am not happy with the condition. Feel they are not as described in light of how much I paid. Nowhere did you mention items had been repaired, were stained or had holes in them. How do you want to resolve?'

Take photos of the damage and send them. You can append photos to eBay messages.
