bought a damaged buggy

I bought a Pushchair from Ebay and collected.

The ushchair was in the pram mode and when we put it in the seat mode and put out 6month old in it the seat kept falling back.

Does the seller have to refund us?

The seller states "No returns" and they are a bussiness seller.

The buggy nearly tipped DD2 out of it when it fell back.

if you paid by cash you have little chance of getting anything back. Did you not check it when you bought it?

if you collected you are deemed to have inspected goods;

even with business seller was it BIN or an auction? because if an auction the sale of goods act does not apply; all auctions are legally deemed as selling 2nd hand goods and therefore have to be as described rather than "fit for purpose and last reasonable time" etc which applies to new goods

DP picked the pushchair up and the seller showed him but the pushchair was obviously empty so he never knew about the seat problem. we only found out when we put DD2 in it.

the seller agreed to a full refund luckily. so we did get our money back.
