Item not as described

Dh paid for by paypal and collected a car part from private buyer. On having a workshop check it , it has been found that there are hairline cracks that means it is unusable.

Buyer is saying he had it checked before going to auction and will not offer refund.

Can he go anywhere with this?

no - a car is not covered by paypal, should have paid cash only.

Sorry, should have made that more clear, it was an engine part not the actual car.

If the item is not as described then open a claim through PayPal. If it is described as good working order but is broken - it is not as described.
What did the seller say?

but it was collected? If you file a not as described case paypal may not refund at all, and if they say they will refund you will have to return tracked before you get your money back.

Static - the seller is saying his garage told him it was in perfect order.
He is a private seller.

Lily- it was collected, but the cracks are hard to see and the part was greasy so although dh looked he obviously missed them.
I told dh that i thought if you collected it was sold as seen and he would have no come back, is this true?

well it is worth opening a not as described case but I think as it was collected you lose buyer protection - I would open a case anyway and see if ebay tell you to return for a refund. But if they do you will have the expense of returning it with online trackable proof of delivery.

Dh has sent pictures to seller as he requested them, have heard nothing so dh is now going to escalate the case.
Think this not going to go well though.
