New face cream but past its expiry date

Please can one of the Ebay experts help me.

I bought tube of face cream on Ebay last week. The item was listed as new with no mention made of expiry dates.

It arrived last night and is still sealed, however it has past its expiry date. The expiry date stamped on tube as 05/13. It is 100% natural and I am worried that it may be 'off' beyond this date.

Can I ask for a refund, or is it my own stupid fault for not asking?

I would try it before deciding if it was poor quality. If it seemed fine I would happily enough use it. If it seems off then I'd ask for refund.

I wouldn't try it - have you messaged the seller?

And no it is not your stupid fault btw - seller is totally in the wrong here, not you.

I have messaged the seller twice. No response.
I think I will give it until Monday and then open a dispute.

I would open the dispute now, you still have to wait 8 days to escalate, no point hanging round till Mon I reckon. 2 messages ignored suggests seller is not going to reply or be helpful?

if it is a business they should answer any message by lunchtime monday then open dispute but you will be asked to return in the new state ie without seal broken for a refund so do not open it

Seller responded this evening, asking me to return it and said she would refund in full. She has agreed to pay the return postage too, and that I should send it 'signed for'.

So hopefully this whole thing should be resolved soon.
