won sofa and seller refuses to sell it

I won a sofa on 17.06 at 6 PM.
I texted seller today and he says (in text) that he contacted me on 18.06 (true, on ebay, but I didn't look into my messages) and that because he put on his ad "It's advertise elsewhere, so it could be withdrow at anytime. " he was allowed to sell it on gumtree

I said I think is against the rules.

Apparently not!

do I have to pay him fo him to refuse payment and then report him using goo.gl/QE6J7

Tell him he needs to cancel the transaction:

However unless it was sold within 12 hours of auction end, there was no reason why he couldn't have cancelled the auction anyway. If he goes through the cancellation process you can leave him negative or neutral feedback if you feel strongly enough about that.

It is against Ebay rules, I think, but in reality there is nothing you can do about it.

I would still tell him to cancel the transaction officially then leave negative feedback that states he had plenty of time to cancel the auction or inform you it had been sold elsewhere.

and do not agree to cancel the transaction and leave appropriate feedback and stars stating non performing seller refused to sell you what you bought.

If he refuses to cancel then he is an idiot as he will have to pay ebay fees on it.

it isn't possible to force him to sell to you - yes you could pay with paypal then you would file a not received claim to get your money back - otherwise he could file a non paying report against you, give you a strike for non payment plus you won't be able to leave feedback.

how much was it - I would pay, leave a big fat neg and stars of 1 across the board, then log into paypal itself and file not received claim and escalate straight away to get your money back. And if he sends a cancellation request don't accept it or ignore. If you ignore it will close and he will get fees back too, so you must refuse it.

ok - so are you going to pay him by paypal? I know it is hassle but you will get your money back and it will scupper his chances of filing a non paying bidder report against you.

can you please give me an example of a negative visual comment I can leave so everyone knows - he has ~450 items in his history so really should be careful of his history (and few more items to sell on the go)

if you pay by paypal and he immediately refunds that will close case so he will not get non performing buyer strike, you can of course still leave low stars and negative comment keep polite as fergoose suggested otherwise he can get it removed, also if refunds when requested he automatically gets his fees back without having to ask for cancellation as that is considered buyer settling case without ebay involvement

if he politely replies I have refunded you in full as unfortunately item no longer available he will look fine as a buyer

Even if you leave negative feedback, he can comment on your comment, so may not be that helpful after all.

he could easily reply " I apologised to buyer and refunded immediately sorry for inconvenience" and then he looks completely reasonable

The low stars are important as too many of those and he'll get an eBay suspension/ban. Just make sure you don't give positive feedback with low star as it can be removed.
