what? where did you read that? You are entitled to a full refund, but you will probably have to return item at your own expense (if this is a not as described case). The seller is never allowed to keep the original p&p. If you don't believe me open a case with ebay.

The items already gone back and we had a partial refund today.

well they are wrong - you have proof that they received the item? just because a seller says something in their answers it doesn't make them right.

Tell them to refund in full or you will open a case with ebay to get all of your money back and will leave appropriate feedback and stars.
