Returned an item that didn't fit, and seller is saying...

that the dress is stained, has marks on the hem, smells of perfume and the ties have been tied . Well, I tried it on for one minute and that was all. I certainly didn't eat anything in it!! She's saying she's not trying to get out of refunding me - but it sounds like she is!! Why do people DO this???????

eBay do sometimes give money for refunds, I had this from the other side, someone returned an item broken and I phoned eBay in a tantrum and they paid the refund. I was a business seller, I don't know if they only do it for business sellers or if they do it in all unfair cases.
