Hi all, advice needed please.

I bought a jacket on ebay. When it arrived, the sleeves were really short so I checked the label and it is a petite - and I am tall! There was no mention of this in the listing and obviously I wouldn't have bought it if there was. So I sent it back today and asked for refund of original cost plus all (both lots) of p&p.

This is the reply from the seller...
Hi, only just got in and seen your messages so apologies for the delay. So sorry my mistake. Thankyou for returning to me and you will receive a full refund however as stated in the listing I cannot refund return postage as this is paypals ruling due to the distance selling regulations. This is the law so the system only allows us to refund upto the maximum amount you paid in the first place. This is why it is stated in every listing. THankyou for your prompt postage and refund will be done immediately as soon as it arrived. Many many apologies for not noticing it was petite.

In her listing she says return p&p has to be paid for faulty garments - but this was not faulty and I am really p'd off that I am out of pocket.

Is there anything I can do?

A good seller will refund return postage costs but there is no way you can enforce this. All you can do is leave appropriate feedback and stars.

She's being outrageous - I would lodge a complaint with eBay. They're normally really good - they paid postage for me in a similar situation.

The seller can send you the difference as a gift paypal payment anyway - the law and distance selling regulations part is totally wrong and your seller does not know what they are talking about!

Leave her negative feedback.

The same thing happened to me, they would not refund postage. I left negative feedback and the next day i got a nice email apologising saying my postage had been refunded and would i please withdraw my feedback.

I said no!

If i make a mistake on my listing i refund postage.

Why should you be out of pocket for her mistake.

That's really bad of her.

Maybe she genuinely believes the distance selling regs thing, and needs reminding (telling!) that this is not so.

What is the seller on about! I have refunded TOTALLY a couple of times including postage of course and I must say received lovely feedback/comments.
She wrote a nice reply so perhaps it is a genuine misunderstanding on her part.

Jardy - it was a 'nice' reply because she's trying to get out of paying the postage and dressing it up with bulshit 'legal' stuff. Just a different approach from the usual agressive response.
