Should I open a case or wait ?

I bought a low value item on ebay - a cheap watch. The seller has only just registered and has a low feedback but all positive.

However when it arrived it was just an empty envelope. It could easily have slipped out as the envelope wasn't taped down - you know the type of seal which is a bit tacky rather than superglue.

Anyway, then I get a message from ebay saying the listings have been removed and i am not obliged to pay for my item, but if i already have either contact the seller or wait 10 days and go through the resolution centre.

What should I do to get my £10 back ? contact the seller and say it was lost in the post or wait and raise a claim.

contact the seller and tell them what has happened, if they don't offer the refund then open a claim.

I'd do pretty much what ebay says - contact the seller, give them a chance to refund and then open a claim.

I just think it looks like I am being a dodgy buyer here as he's obviously got himself into trouble over something and now it looks like I want to take advantage of it - Which I am not honest !

Maybe I am over thinking this Confused
