Advice needed please

Bought DD a pair of shoes from a ebay shop , they arrived quickly and were great except one shoe was a different size . Emailed the person and explained , he was very apologetic and asked me to send them back , that he would refund the return postage etc . Fair enough . So posted the shoes back first class last friday . Emailed him the other day to ask if he had sent the replacement yet and no reply . DD is whittering for these shoes and i dont know what to say to her . I dont like leaving neg feedback because it was clearly good old human error , the first mistake , but i am getting a bit frustrated now .

How did you return them ? Did you use recorded delivery so you have a signature and proof of delivery ?
Is the seller saying that they have not been received back yet or are they just ignoring your messages?

You could request the seller's contact details from Ebay you can do this via the resolution centre links and give them a call. Sometimes personal contact works better than an email.
Are they a business seller ? If so you may be able to find a telephone number out through Google if they don't have a number listed on Ebay.

Did you return them after opening a case ? Either a return case or a not as described case? Or have you just messaged the seller and then returned them ?

Hi ,
i could kick myself because i didnt send them recorded ! i do have proof of postage though . I didnt open a dispute as i wanted to give them chance to deal with it without as they have very good feedback. I did all the messaging through ebay so have a copy of his replies . I have just sent another message asking him to please let me know when i should expect the replacement . Will give him till sunday to reply and then open a dispute i think .

Ebay will only be interested in proof of delivery and the proof of postage is unlikely to help you. However it's certainly worth trying an item not as described case.
You probably know this now, but that extra few pence spent on recorded when returning an item is worth it.

I have to admit that I don't understand your seller's behaviour at all - mistakes do happen, they know one was made here so why not just exchange the item?
The ignoring you part is a bit of a worry I have to say - so I would open an item not as described case now, state that the item has already been returned and give as much detail as possible. Including information about your messages.
I don't suppose you took photos of the different size shoes as proof did you ?

If you get no luck from Ebay or the seller you could always try and claim your money back from Royal Mail - their item limit is £46.
You would have the proof of payment from paypal and the proof of postage would be relevant to them.
You'd have to wait 15 working days from the date of postage and have confirmation of non-receipt from the seller before claiming for lost post.

Hi the seller has come back to me, apparently my parcel hasnt arrived , they are going to check their sorting office and also are refunding the postage cost for sending them back . The parcel has got my address on aswell , so it may come back to me .
