Been sold a fake DSi game and seller says it real

I bought a DSi game last week and when it arrived it wouldn't work on any of the DSi's we have in the house it always says the same message. (some of the DSi's are only 1week old and the other DSi is 3 weeks old.)

"An error has occurred. press and hold the POWER button to turn the system of. Please refer to the Nintendo DSi operations manual for details."

The problem is we also bought another DSi game and when we went to leave positive feedback for that game it went on the "fake" game and not the one we were meant to leave the feedback for.

When we found out about the first game being fake I phoned ebay and the man said as I have messaged the seller and he is saying its real, we will have to open a case against the seller.

I asked about the feedback problem and the man at ebay said "its ok and as he can't remove the feedback it will have to stay".

He took me through opening the case for "item not as described"

Now the seller has said that the game is real and it was factory sealed, he will not accept a return for a refund.

I have looked on the internet and found this www.wikihow.com/Determine-if-Your-DS-Game-Is-Fake and most of the things point to the first Dsi game being a fake.

Does anyone know what we can do? We have until 7/1/12 before I can escalate the case against the seller and we are worrying incase Ebay find it in the sellers favor as the feedback was left to the wrong member :(

I can't help with the ebay dispute but we bought a used dsi game from a game exchange shop and it displayed that exact message when we tried to use it.

I took it back and they were very apologetic as it was a fake and they said they normally manage to spot them when people bring them in . This one had slipped through their net but they swapped it without a problem.

So, yes, yours is a fake (but I guess you already know that!).

Good luck and persevere through ebays 'not as described' process.

Has the seller got any bad feedback?

We've had this before, my SIL bought my DD a game and it won't play on her DSi. I didn't have the heart to tell SIL so we never did anything. Though it plays on my DS so DD has still been able to use it. I was suprised by how convincing a fake it is, factor sealed, etc. Very professional. I won't buy games off ebay now.

Definetly open a case. Did you pay by Paypal? You might be able to get the money back through them? Hope so.

yes we paid by Paypal.

The seller has a few bad feedback left in the last few days saying "item is fake" and "is still awaiting the refund been waiting 3 weeks"

These feedback came after we bought the game.

We wont be buying anymore games through ebay after this is sorted.

If you opened the dispute via PayPal you have to prove it is not genuine, if you opened by eBay your seller has to prove it is NOT fake.

I hope you went the eBay route, if so you will either win a no fault refund, or have to return trackable for a refund.

We opened it up via eBay as the person on the phone talked us through it.

I escalated the claim last night and Ebay have refunded us the full price including P&P without us needing to return the game to the seller. We have looked at his feedback this morning and there is more problems with fake items being sold.

glad you got your refund - please don't let one dodgy seller put you off buying games. Just check feedback before buying - and I only buy games from UK sellers too - so easier to return if need be

As the positive feedback meant for another seller went to this seller I cant change the feedback, Ebay tried and they couldn't so I just edited it to say the problems we had.
