Advice about refund

I bought some items on 4th December as Christmas presents and have been waiting for them to arrive.

The items dispaatched icon on Ebay hadn't been actioned so had messaged the buyer twice to find out what was happening.

Today I'd had enough and have initiated a dispute via Paypal. Didn't escalate straightaway as wanted to give the seller a chance to respond.

Tonight I've had a message through Ebay to say their internet has been down so couldn't get my details to post. I've said I'd rather just have arefund now as I've had to buy alternative gifts.

Apparently they have no funds in Paypal and I'd have to wait until Friday for her wages to go in for her to transfer some funds back in to then initiate the refund - which will probably not be until the middle of next week!

So i have the option of waiting for a refund or her posting the goods to me tomorrow.

My question is - if I escalate in Paypal will I automatically get a refund or will I still have to wait for her to get funds in there?

You don't have to wait for her Paypal to be in credit as they will put her balance in negative balance, but you are being unreasonable as 4th December was not that long ago.

I gave her a few more days for the item to be posted, but as nothing has arrived I escalated the claim with Paypal. It now tells me that I have to wait 10 days for her to respond. Is this because she has marked it in ebay as dispatched now?

No once escalated PayPal always give the seller ten days to respond. Even if they responded on day 1 still ten days has to elapse.

I got the impression from what Fergoose posted that the refund was fairly instant - but her/his answer has gone now to check!

dunno what happened there? But no, a refund isn't instant but they are pretty quick at refunding once escalated, a few days I think.

The minimum time you wait before you get a refund is ten days.

That is because a seller gets ten days to respond, once the ten days have passed if the seller has not put valid tracking you can ring PayPal and more or less instantly get a refund.

now the 10 days have passed with no response from the seller, how long will it take Paypal to review the case?
