stated as new but its not help?

wwud? so i bought a trike from ebay on my phone its at christmas present for my niece so i needed it to be new, it was listed as new not new(other) im the first to admit i never read the description fully as it stated it was new, only once i recieved the trike the box was clearly used bashed dirty had been opened, trike has been used. at the bottom of the listing it say that it was used for display purposes only but looks as if it was on shop floor for everybody and anybody to use
should i just accept the fact i never read it and its my own fault or would u reclaim your money?

Well new is meant to mean new, not as new or a little bit used. It's not an ambiguous word so I would say your seller wasn't totally honest with the description and you are entitled to be unhappy. If it was display purposes it should not have been listed as new surely.

I would email seller first, then if no joy open dispute. You will need to send it back with tracking info to get your money back though, the seller may reimburse this, but may not.
