you can report it to eBay if they have stolen your pic you know

a polite email to the seller pointing this out may be sufficient

Ebay said not to contact the seller as then they'll know who reported them. I'm more annoyed as due to the nature of the product I showed the product codes so people knew it was a non faulted version. So the poor old buyer could have purchased any old crap under the belief they were purchasing the item in the picture.
