Hello - I won a bra on ebay that was listed as brand new with tags (could clearly see tags in picture too), and it was posted to me pretty soon.

However, there were no tags on the bra (and they wernt in the envelope etc). The bra looks in pretty good nick though, so I think its new,

I sent an email to the seller saying that the item wasn't as described, and left it at that.

Got a reply saying sorry, would i like a refund etc (though they said at that price it would be a shame).

I sent one back saying, sorry to be so fussy but yes please I would like a refund - as I wouldn't have paid so much for it If I knew it didn't have the tags.

Have got a snotty reply saying that they've just found the tags, should they send them to me, or is there really another reason I want a refund.

AIBU, to be so picky? And should I press for my money back - including postage?

I should add the reason that I'm doubting is that I don't really want to keep the bra anyway, so feel I might not be so cross if I loved the bra.

bnwt means tags attached so you are right. the seller posting you the tags separately isn't really the point is it

you will need to send it back recorded, but yes you can get all your money back as item not described, and the seller should give you your return postage costs too, but you can't enforce this unfortunately

MotherPanda · 09/11/2011 17:46

Thanks fergoose - it's hard to tell if I'm just being a picky arse about things sometimes. will try to press for a refund.

no I don't think you are being picky. you prob wouldn't have bought it if it wasn't bnwt - it is your right to complain it is not as described. If you open a case with ebay they will tell you to send it back with a tracking number and they will refund you all of your original payment.

Honeydragon · 09/11/2011 17:49

Say its for a friend who needed it so you needed it as it was in the photo. She should have put new without tags, not with.

Housewifefromheaven · 09/11/2011 18:02

Well yes yanbu, but will it be worth it once you pay for recorded return post? Do you like it? Just don't end up cutting your nose off to spite your face!

MotherPanda · 09/11/2011 18:03

can the seller leave any sort of bad feedback on an item they refund? I've just sent an email saying that to send on the tags isn't acceptable, and that i want a refund.

Will wait till tomorrow, and then open a case if I don't get a response - I'm just worried that my being confrontational will have repercussions.

Its not the bra of my dreams, but I don't despise it either. I'd rather my money back, I could buy something without the tags for much less you see.

no sellers can't leave a neg, and if they leave a neg comment on a positive rating it can be removed

you have nothing to worry about, you don't need to explain yourself to them at all. They are in the wrong here - totally, so don't feel guilty about it.

Tryharder · 09/11/2011 23:22

I think you are being unreasonable (although I do appreciate that this isn't AIBU). Are you happy that the bra you have in your hands is not the same bra in the photo? If so, then what does it really matter if the tags are present or not? They probably just fell off.

You would have to remove the tags in any case before wearing it so......

squeakytoy · 09/11/2011 23:31

The reason people take tags off, is to stop people returning items to the shops.

ASuitableGirl · 09/11/2011 23:36

If the tags were in the photo then they should still have been on when you got the item. If she's found them then she must either have taken a photo of a different bra, or taken them off before sending it. Either way it's not what you bid on I don't think.

squeakytoy · 09/11/2011 23:38

I have seen auctions though, where people have stated that they will be removing the tags before sending the item. Personally i have left tags on things, but I know of a few sellers who remove them. Ususally if the article sells for less than its original price.
