Bought printer ink and it doesn't work!

I bought a print ink pack from Ebay and have just gone to test it-there's no ink in it! It was sold as open-(bought in error) but new and unused. I h;ave emailed the seller, but notice their listing says 'no returns'.

Does anyone know where I stand on this-surely they can't just sell faulty goods?

Email to let them know its is not working an empty, explain you want a full refund as it is not a return, it is clearly not item as described.
Give them 2 days to reply and offer refund.
If no joy tell them you have never left anyone negative feedback but will do and will take out a claim with ebay. Do it ASAP as you have a limited time.
My mum ordered some inks on ebay too, they also shown empty but it turned out to be her printer as they were not originals it would not recognise them, so this is also a possiblity.
