Paid for item... but seller still hasn't despatched

Hello,

I won an auction on Sunday 23rd, and paid by paypal straight away (immediate funds, so no waiting for it to clear).

Estimated delivery date said 27-28 October - I paid for 1st class postage but by the 26th It still hadn't actually been despatched, so I sent an email just to ask the seller when the item was going to be posted, more so I could guess when I was going to need to be in to receive it than to have a moan and got a nice email back saying sorry, was waiting for a box big enough for your item - will definitely post tomorrow (meaning the 27th).

It's now the 29th, and the postman has been and gone, and the item still hasn't been marked as despatched. So even if she sent it today, I still wouldn't get it till the 31st/1st Nov.

I don't want to bombard the seller with emails, but am i within my rights to get a bit annoyed about it not being shipped yet - Her ebay listing said she would post within 3 working days (so monday, tuesday, wednesday) and that I could expect to receive it within 4-5 working days (so Thursday, Friday).

How long do I wait until I contact her again, or open a not received dispute?

I'm just a bit annoyed about it, because It's a Bumbo seat for my DD and we want to play! Plus, I paid for 1st class postage, as I wanted it quickly.

If it does turn up next week - do I leave neutral feedback, or is that too harsh for this?

sellers have 7 days to dispatch under paypal rules.

If they still haven't marked as dispatched and they said they would send on the 27th I don't think you are unreasonable emailing them again.

I would open a not received dispute if it does not arrive tomorrow. You have to wait a certain time (think it is 2 weeks) before they refund you anyway but in the meantime hopefully the messages she will get from them will spur her on to post it to you.

I have had this 3 times recently with Ebay, the first eventually admitted she did not have the item in stock, the other 2 just did not respond to my emails and I was eventually refunded for all 3. I do not buy very often from Ebay so either I am very unlucky or this is a common occurrence.
