Buying software - if not legit will I be covered for refund?

hello,
I'm looking to buy some software on eBay. I've found an old version (its version 2 of a program that is now avail. new at version 5.5)

The old version will work fine, and think the price is fair at the BIN price, but still a bit worried it could be dodgy. If it turns out to not be legitamit software/doesn't allow activation will I have recourse to a refund/protection with eBay/paypal? The description doesn't seem to imply anything but the actual product, shows picture of case and lists CD and serial number included.

Seller has 100% positive feedback from 145 buyers, spread over a year or so.

What do you think?

Yes if it's not as described you can claim back through Paypal. I claimed back for some CDs of software which were fake a few years back.
