Stained shorts

I won an auction 8 days ago for a dress, 3/4 length shorts and top.
They have arrived this morning and the shorts have an inground stain on the knee, (really obvious mark) and smaller stains around the pocket. The dress and top are fine!

I have emailed the seller and told her about the mark and said I have taken photos if she wants to see them (although how she wouldn't have seen them is beyond me).

I'm not sure what to do now, she has no items for auction at the moment so might not check her ebay account, Can anyone tell me the next steps please

If no joy from contacting her directly, open a dispute with eBay. AFAIK if they find in your favour you will have to return all items to get refund so if they weren't the most important part of what u bought u need to decide if it's worth returning all the items.

Thanks RockChick, she replied to my message saying send them back and she'l get the stains out! Also added that they hadn't even been worn, hmmm I beg to differ, best bit was when I looked at them properly they have red biro on the back too!
Will cost me more to send them back than they are worth so will chalk it up to a bad experience!
