Would you accept a partial refund in this instance?

Sorry to start another thread but everyone ignored last night's and I am terminally confused.

I bought a sink last week. It had a photo of the original box, I asked the seller to pack it better than that as it looked fragile.

He said it'll be fine, it's insured and he would pack it well. Well, he didn't - it arrived just like in the photo, and broken.

I returned it immediately, parcelforce are returning it to him. I didn't pay for this as it was damaged on receipt (normally in a dispute you have to pay for return delivery).

Anyway I opened a dispute as he had gone quiet; he said how about he refunds me most of it but keeps some towards the postage, as he had to pay extra out of his own pocket in the first place.

I feel sorry for him - he's putting in a claim with PF but don't know if they will pay out. OTOH I have no sink, he's got my money, I should get a full refund really including original postage.

Feel sorry for him but not sure what to do.

Any thoughts?

No way! He refunds you the lot not a partial refund the cheeky git!

IngridBergmann · 22/03/2011 08:12

Thanks...just feel bad for him as it was such a lot! He might get a payout anyway from the insurance.

I'm sure he'll find a way to get something back. And I told him to pack it better. I loved that sink Sad

His decisions around postage and packing really arent your problem. You should get a full refund.

sixlostmonkeys · 22/03/2011 08:22

no, you need a full refund.
He has learnt an expensive lesson - pack items well!

Thankyou. I'm supposed to get a full refund when it's delivered back to him...I returned it last week, it was attempted yesterday but refused? But he says no card was there.
It's been rescheduled for today (by him or someone else I don't know). I checked the address is correct.

He has agreed to refund the full amount officially but is asking me by email if i'll let him off some of it...I think I'll wait and see what happens with the tracking, and once it's been signed for I'll answer.

I will probably say no but I'll do it nicely. He's already left me good feedback - I haven't done his yet.

you are right - wait until you have the tracking and then there is no reson why you should not expect an immediate full refund.
You could either ignor his email or reply (nicely as you say) Sorry but I'm not in a position to help you out financially with the costs you have incurred. It is such a shame that the packing was inadequate as this has left us both with disappointment.

He's cheeky, I'll give him that

Thanks Six, I consider you an expert Smile

I think he is appealing to my kind nature. Which I may have accidentally misplaced, today...oh dear Smile

Continue to misplace that kind nature. You should get a full refund.

Pandsbear · 22/03/2011 12:13

You should get a full refund! Seller should have packed it up properly - it isn't your fault.

bemybebe · 22/03/2011 12:40

full refund vote here also

ilove · 22/03/2011 13:15

I hope you have already done a chargeback through paypal - they will refund you immediately as you have sent it back tracked.

IngridBergmann · 22/03/2011 14:20

How do I do that, ilove? Paypal were useless yesterday, as I'd opened a case through ebay so they said I couldn't open one with them too. Can I still do a chargeback then?

Ebay is rubbish, the call handlers don't have a clue what I'm asking, you can't get through to anyone. I wish I had done it with paypal but I thought you could do both, and a big box came up saying 'open this dispute through ebay' so I did and then paypal wouldn't let me.

He's meant to refund within three days now, but I don't know what happens if he won't. I've just sent him a message saying I'd rather have a full refund.

Just to say that he did refund, a couple of hours ago...phew! Thankyou for all your help.
I might get some sleep tonight now Smile
