Bought a fake, WWYD?

I bought a pair of designer jeans on ebay which looked genuine from the listing (pics of the tags etc).
As soon as they arrived it was obvious they are fake and I emailed the seller and politely asked to return them for a refund.
She denies they are fake but says there were bought 8 years ago and she has no receipt.
She says she wants to take advice from ebay about what to do and doesnt want to lose out on her fees etc.

Should I put in a claim or give her time to take advice and get back to me?
FWIW I spent £24 including postage.

I would wait for her to get back to you.
She may let you return for a refund.

If you put a claim in then you have to prove they are fake. You would have to take them somewhere and get a written piece of letter headed paper stating same, alternatively if you purchased from a UK seller Trading Standards might be able to help.

See what she says first, however if you send back she may relist and someone else will get a fake.

So if she does say return for a full refund, once you have your full refund and return postage costs, remember to send back trackable. Leave negative feedback to warn others.

Ebay removed something of mine once for being a fake, (it wasn't) didn't re list though as it wasn't major and could be arsed with it being removed again.
I would open a dispute with ebay, as you only have a limited amount of time, that is what she will have to do anyway once she has taken this advice, but it's not up to her to dictate whether or not she should refund.
She may genuinely not think they are fake, but you know different and as they are hers to sell thats her problem. Seller fees will be refunded to her anyway if it's resolved Smile

I bought some fake uggs. Opened a case via eBay. The seller said 'they're not fake' I said they most definitely are and psypal refunded me, took about a month because they give the seller a certain period to respond. It was very straight forward. I didn't have to prove anything. I kos gave my money and a gross pair of fake boots o don't really know what to do with

Thanks all, she has now agreed to a refund, not very happily though.
What is the deal with postage refunds, who should cover what?

you are not supposed to return fakes on ebay. Get them verified by a retailer as fakes and opena dispute stating they are fake. Fakes are supposed to be destroyed.
