Aaargh mad seller!

I recently bought some maternity jeans off ebay. They were described as being "in brilliant condition".

When they actually arrived, they smelt musty, had various stains on them and had a rip/pull at the top of one of the legs. Not exactly in brilliant condition...

I contacted the seller immediately and said they were not as described - I wasn't actually fussed about the smell or the stains (as these would probably come out in the wash) but I'm a modest kind of person who doesn't like showing her knickers so the rip/pull in the crotch was a bit of a deal-breaker.

Anyway, she wasn't having any of it, said they must have been damaged in the post, and asked me to return the jeans for inspection, which I did. She is now accusing me of damaging the jeans myself and is going to send them back to me Confused

I have raised a dispute with ebay but what happens if she sends them to me again? Will ebay refund me? Really don't want a damaged pair of jeans...

open a dispute, insert the tracking number to prove she has them back, and ask for a refund

Thanks sixlostmonkeys but I can't escalate the dispute because 10 days haven't passed yet...she knows this and this is why she is sending them back!

So much hassle, it's really put me off ebay.

she may not send them back or you may not receive them. If she doesn't send them trackable then she can't claim she has sent them back to you. Even so, you can still escalate when the 10 days are up

Always open the dispute with PayPal you can escalate immediately for a SNAD dispute!

I hope you returned trackable? You have to get a refund.

If you did return trackable and she sends them back to you do not take delivery i.e don't sign for them.

Thanks again - I know I should have opened the dispute with Paypal but it said to go back to ebay - so that's what I did.

Have told her that if she sends them back to me I will not be signing for them. Just don't understand why anyone would want to waste another £3 or so on postage rather than just accept that they misdescribed some jeans!
