I want to return a fake. They will not refund me until they receive the item. I will not return the item until I receive the money. Who is right?

It is standard that you return it and then they refund it.

Have you reported it to ebay as a fake, if you do they may award you the refund without having to return.

If you do have to return it ensure that you use recorded delivery as you will need proof of delivery to get your refund if they refuse to refund you IYSWIM

They are. You have to return the item (get proof of posting - you need the tracking number in order to process the disputeO)

maxybrown · 01/11/2010 22:46

agree with cargirl - report a fake to ebay but it is correct that you return recorded delivery

cheesesarnie · 01/11/2010 22:47

theyre right.its always return first then refund.if you dont get the refund you can open a dispute and if you paid using paypal youll usually get your money back.get proof of postage though

classydiva · 01/11/2010 22:56

If you went to dispute with PayPal you would not have to return at all, however you would have to get proof the item is fake.

Do you have proof? If so open a dispute in PayPal.

If you have no proof, return trackable at your own expense for a refund, ensure you receive all your intitial costs back.

classydiva · 01/11/2010 22:56

it is not a dispute because PayPal do not ask you to return a fake it has to be destroyed.

OnEdge · 01/11/2010 23:15

thanks for putting me right. Out of interest how can you obtain proof something is fake?

Go to somewhere where they sell it and ask them to authenticate it for you.

If it is going to be hard to do, all you can really do is return at your own expense trackable.

maxybrown · 02/11/2010 08:17

That's interesting, I returned a fake recently too, will remember that from now on thanks!

classydiva · 02/11/2010 18:11

eBay may require you to return it it depends, but if you open a PayPal dispute they never require you to return a fake that you have proved to be the case.

catholicatheist · 03/11/2010 15:08

usually you have to return items before you get a refund. Dont know about fakes?

classydiva · 03/11/2010 17:30

if you can prove the item is fake then you do not return, you have to agree to destroy the item, if you cannot get proof it is a fake then you open a not as described dispute not mentioning it is fake, then you have to return at your own expense trackable.
