Ebay item arrived this morning smelling of fag smoke and dirty

I bought a Baby Annabel chair off ebay for DD for xmas. The listing described it as ' only been in toy cupboard' and with tags ( so admittedly didn't really specify condition iykwim) but arrived this morning smelling of fag smoke and the chair is dirty with stains on it and scratched with hair stuck to it....basically fit for the bin.

What do I do?

I'm going to contact the seller obviously but I'm not sure what I should suggest. It would cost me what i paid for it to post it back to her.

I understand that i could get postage back if item is not as described. But she didn't actually say it's condition..just implied it by saying it had tags attatched and it had just been sat in a toy cupboard. When in fact it looks like the world and his wife have played with it.
So what would you suggest I say in my message to her?

Not sure how much you paid but ask for a refund of all or a portion of the amount.

I did this with a pair of shoes which were 'brand new in box' the toe on one was (admittedly) slightly scratched so I asked for £5 refund and she gave it. The answer I got was that she had bought them off ebay and put them straight in the cupboard as they were a size too big. When she remembered them they were too small so she just re-advertised without looking at them. Not sure if that was true but I saved me a fiver, and if you don't ask you dont get.

I don't really want to clean it up as it's grotty plus it stinks of fag smoke so i don't want my daughter playing with it.

I've sent the seller a message explaining that i will be returning it via recorded delivery in return for a full refund including postage. She probably won't agree be it's worth a try.

I'm not bothered about the money as it cost next to nothing but it makes me so mad that people think they can sell rubbish and get away with it.

Oh I know, I bought what was described as 20 items of fancy dress. My daughter only wanted the main item in the picture which was a long white princess dress.

The bag arrived and as soon as I broke the seal the smell hit me, it was rank, and the blinking white dress wasn't even it in.

I complained to the seller who gave me such a sob storey about being ill, not having any money etc. In the end I said just send the white dress, the rest when straight in the bin.

She never did send the white dress then got all upset when I negged her. Probably the same woman!!

just leave negative feedback - no point in pretending everything is A+++++++
when actually it is rubbish.

No point pursuing a return and refund anyway

no, you should contact the seller before leaving negative feedback.

I learned this after leaving neg fb for a pair of jeans I bought for DD, supposedly new... but with a big yellow felt tip pen stain on them! Straight in the bin.

The seller offered to refund my money.

juat to comment on the fag smoke thing, i got a dress, arrivedin one of those grey postbags, and it reeked of smoke. contacted seller who was horrified, and said she didn't smoke bla bla.
i googled smokey item and got a search result with someone asking on yahoo a similar question. The response was 'oh it didn't come in one of those grey postbags did it, they can make things smell awful'

my item was very synthetic, and tbh i did think it may have been a reaction. anyhow, febreze did wonderd, and the seller in my case did offer full refund.

I personally think that is shit. refund or no, why did you get substandard product in the first place?

I can't be bothered arguing with them. If I receive bad service I leave bad feedback. Just my opinion

Well she has replied to my message saying that she doesn't usually allow refunds as she describes everything accurately!
But if I want to return it she would like to see it to see what the problem is but that she won't be refunding my postage.

Where do I stand with this? can I open a dispute? if so how?

really depends on what you want out of this, if you want your money back. How much you paid in relation to how much the postage was. ie if you are going to spend loads more to get it back for a measly amount paid for the item, and she refuses to pay postage then it's not worth the hassle.
YET, you can start a dispute, paypal will refund you, and you could give her neg feedback.
You still have to return the item tho.
