bought a phone, paid, now seems i'm the socond to loose out on buying it!!

bought a used phone on friday evening, it was ending very soon so i just bid, won paid instantly... then looked on her feedback and seems she sold it a week earlier but didn't even give the buyer 24hrs to pay before saying she was re-listing... anyway- i just held onto hope- monday it was marked as dispatched so thought all was fine.

This morning i get a message from her saying my paypal transaction wasn't completed at her end and why? I sent one back saying i'd paid with paypal funds and the transfer was instant. sent her the details that were on my paypal transaction page.

Just now i've logged in to find that apparently her 'baby brother broke it just as she was about to wrap it up to send'... asked me to cancel the payment....

Now i've just decided i'm not bothered about the phone and just want my money back- was gonna buy a new phone in 2 weeks anyway- this was just to last till payday as DH broke my phone.... explained how she can give a refund thru paypal but really worried that she's had my money since frieday, marked as dispatched then I get these messages...

So.... if she doesn't refund how do i go about getting the money back? and am i guarrenteed to get ALL my money back? or only what she has in her account?

Ask her to send a full refund. If she doesn't, open a paypal dispute. You should get all of your money back. Sometimes when you open a dispute you wait longer as paypal move slowly, so I would ask her to do it before going down that road.

have done that, even explained how to do it as from the way she typed and said 'my baby brother' i gathered she was young, and she doesn't have that many feedbacks so probably wouldn't know how to do it.

Can't you cancel the paypal transaction yourself? I'm about to post a question about my buyer cancelling a paypal transaction because he hadnt heard from me so it seems it can be done.
