Hi - I plan to file for divorce as soon as it’s been 1 year. Only married 6 months. No kids and live with them in their family home/with parents.

We have no joint assets. I have savings from before I met them and they have a property on rent before they met me which is mortgage free.

We both have similar pensions.

Unhappy marriage due to false promises deceit lies alcoholism. I want nothing from the marriage and just to walk away so I can rebuild and have peace and happiness.

They have their name on 3 properties with one of their parents including that house we live in with them (I have no interest in this as it’s their parents).

We only lived together 6 months (time since marriage)

Would the courts agree to clean break? And we both walk away with what we came in with?

I will go back to my families so will have somewhere to live .

Fill in a divorce application online, will your Husband agree to the divorce? If so I can’t see any issue, it’s a short marriage.

@Apricotdoghe doesn’t want it to end but I can’t live life like this so if he doesn’t sign apparently it will still go ahead? We have only been together just over 2 years and no cohabitation before marriage

He doesn’t have to agree to divorce you can still proceed if you’re in England /wales

it sounds like he has more to lose in terms of assets so if you agree you want nothing it’s highly likely a court ( should it cone to that, hopefully not needed ) to set you back as if you’d never married - ie take what you came in with

@millymollymoomooyes on paper he will look like he has a lot more than me but I don’t want any of it as it’s his parents hard work and I’m not out to take anyone to the cleaners! What if he doesn’t do the finance bit just to be difficult? How can this progress forward?

Well my point is it’s in his interest to do the financial bit. So yes he could be awkward but you simply need to point out that if he plays ball you don’t claim any of his assets, if he messes about then you will and he stands to ( possibly ) lose out ( plus spend more on court fees /solicitors etc)

until you sctudlly do it you won’t know . It’s all what ifs. There are processes to follow in the event he is obstructive - but hopefully he’ll come to his senses because he is the one standing to lose
