Consent order and buying out process

Can anyone advise? I am in the process of having the consent order drawn up. We have agreed that I will buy ex out. So assuming the consent order is approved, i get the mortgage offer, does ex still need to sign to take himself off? He refused to do this before.

I have £££££ in solicitors fees so asking here.....

Yes, he will still have to sign legal papers to do with the mortgage. If he refuses to do so, you'd have to go back to court and the judge there would do it. Happened to a friend and it cost her £15 000 and that was decades ago
