House buyout

We are mid divorce, at the moment still living together. It isn’t great. Conditional order then consent order can be applied for soon. I am buying him out the house. Do I really need to wait for the consent order to be approved before buying him out. Would it be daft of me to start the process now then not complete the buyout until consent order through? I just want my own space. Its a fair split IMO due to housing needs and financial status of us both.

I think if you’re confident that the Consent Order will be approved by the court then you may as well crack on. Technically there could be a small risk that the Judge doesn’t approve it and you have to renegotiate, which could be made more complicated if you’re half way through implementing the original agreement. If you’re both happy to proceed then technically there’s nothing stopping you.

I bought the ex out 3 months before we could submit the consent order. It was very straight forward and a straight 50/50 though. It went through quickly and now all I have to do is sub the pension sharing to my provider.
