Thinking Of Divorce

Im thinking of divorce due to controlling behaviour.

Worried i wont get half of savings or property.

He is older and could he claim because of his age he cant afford to sell up or buy me out.

If i do divorce i will buy a 2 bed apartment i dont want or need a house like we have now i dont drive etc.

Will i get legal aid to cover the cost of divorce.

neyhervkarty is automatically entitled to 50%. Both are entitled to a garbage which could be more or less. They are a number of factors that are assessed to reach an outcome in the event parties n don’t agree

You won’t get legal aid ( in England at least) unless there is domestic violence

Division of assets are based on many considerations. Some of them are: length of marriage/living together, children and their ages, your current income and ability to increase it. And yes, agrs can come into it if he is soon to retire/already retired.

You need to approach a family mediation firm or a solicitor.

No i havent reported it to the police. When i was diagnosed with depression i was refered to a mental health coordinater at the practice i am registered at. I did tell the mh coordinator i wasnt happy in my marriage.

well
see a solicitor and talk through your case. They will be able to advise if they tihink you’ll qualify for legal aid / this is means tested abc you have to have evidence of abuse. You can’t just tick up and say you’ve been abused.

in the event you don’t qualify then you can fo most of the divirce and financials yourself as a litigant in person. You can educate yourself online with the wealth of information about. You can use a solicitor for the drafting of orders only.

you’d be expected to mediate ( unless domestic abuse so depends on your case) and to try to negotiate between you even if using solicitor
