Has anyone had any success in reduction/cessation of spousal maintenance upon ex cohabiting?

My understanding is that the spousal maintenance can only be stopped once the receiving party remarries.

Usually there is a clause that ceases upon remarriage or cohabition

can you prove that ?
what does your consent order state as the triggers for amendment?

It's ususally written into the order, have you checked? If it's not you've got a problem.

It’s rare for it to be awarded, has to be high income and often fairly specific circumstances. It’s worth speaking to a solicitor experienced in this, not all are

It is not easy to use co-habitation to vary court ordered spousal. Have a meeting with your barrister - they'll be better in assessing the strength of your case. Solicitors I find are useless for these sort of questions - because of the way they make money off us during this process. They'll tell you that a range of outcomes is possible, and you can always try - (and pay them in the process)
Barristers are much more to the point and tell you how it is.

I have it for 5 years unless I remarry or cohabitate.

It was in exchange for not having any of his pension.

Vanishingly rare to get spousal maintenance at all these days. Would be written into a financial order the terms for ceasing payment - are you the payer or payee?

tvdinners43 · 19/06/2025 22:39

I got it in my divorce. Ex wasn’t a particularly high earner but he’s self employed meaning that he can hide his earnings and also his earnings fluctuate so I went for this upon my solicitors advice rather than child maintenance. Runs until youngest DC reaches 18 or finishes education. The amount is significantly more than what I’d get through child maintenance and it’s legally binding so if ex DH defaults I can take him to court.
My order states that the order will cease if I remarry. (No intentions to!)

Yep it's written in, the amount, the total amount, the conditions, the date in the month he has to pay it, all the terms and conditions.
