Hi all, I have a question relating to CMS variations.

ExH contacted CMS to arrange the claim, they calculated the figure based on his Apr 24 P60. This was in May this year.

It has come to light his income last year was higher than on his P60, side work with undisclosed amount of at least £10k which they didn’t take into account. He didn’t do a self assessment so they have no details.

he now says he’s completed a self assessment - would they review? Had also had a £10k pay rise and of course another P60 last month.

I've been down the CMS variation route a long time ago. My ex was also earning more on the side. I remember the variation failing (I think they usually do) and if I remember rightly I asked for a mandatory reconsideration, this is where they review things again.

The MR also failed and I continued with an appeal, which led to a tribunal where you can present any evidence you have to prove the ex has earned more than he's letting on. I won and ex was ordered to pay arrears they'd calculated.
