Married 20 years together 33 .
He’s income 90k . I have worked part time to support family 2 adult. Children but currently not working as have mental heath problems caused by years of abuse from Husband .
Finally plucking up courage to leave , do or die ! .
what are my chances of getting 70 percent of house value ?
How can I prove domestic abuse ?
only proof is I told a therapist (NHS ) in 2021 when I was suicidal.

Totally depends on what assets there are and if 50:50 deemed sufficient to provide for needs.

I got 70/30 on the house and left his pensions alone but my DC are still dependent, live with me full time and both have disabilities. I have to home school the youngest while wfh.

I did, in fact 72 % and a Mesher Order - one dependant child at the time and two older teens. I self repped up to a final hearing. It's possible certainly but each case is decided on its own merits.

You’ll need to complete d81 and get consent order drawn up

have you got full financial disclosure? Know what all assets are? Is there a sound legal basis for the disparity etc

have both of you had independent legal advice? You’ll be asked to demonstrate that.

I got 70% but I was housing the kids still ( and worked full time) I think it’s going to be more challenging for you as the kids are grown up and essentially all you need is a home for yourself. Get a good solicitor. Even if you proved DA I’d say it’s an unlikely outcome.
